Maui County regulates vacation rentals through several permit categories with differing zoning, operational, and application requirements. Property owners should carefully review County regulations and permitting procedures before operating a visitor accommodation.

Before You Apply

Before beginning the permit process, property owners should review zoning requirements, operational standards, and County application procedures to determine eligibility.

  • Verify that the property is located within an eligible zoning district.
  • Review County operational and permitting requirements.
  • Confirm that all structures on the property are properly permitted.
  • Review parking, safety, and occupancy requirements.
  • Determine whether additional State or County approvals may apply.

Permit Process Overview

Thinking about starting a Bed & Breakfast or Short-Term Rental Home business? The following overview summarizes some of the major steps involved in the County application process.

Step 1

Before submitting your application, the Health and Safety form must be completed. This form is included in the application package.

Completing this inspection first allows you to determine whether your home will pass inspection before investing additional time in the process. Some owners decide not to proceed after learning what modifications may be required to satisfy Health and Safety requirements.

Step 2

Collect Your Paperwork

A full checklist is included in the application package. Some of the required items may include:

  • Floor plans
  • Plot plan
  • Building permit information
  • TAT/GET license copies
  • Photographs of the house and property
  • A list of all properties within a 500-foot radius of the property, including TMK, owner name, and owner address

A County resource is available online to help generate neighboring property information.

Note: These are some of the major items, but this is not a complete list.

Step 3

Post your application sign at the front of the property at least five days prior to submitting your application.

Step 4

Once all paperwork is complete, and five days have passed since posting your sign, submit the application to the County.

The County will complete an initial review and advise you when to mail notices to all neighbors within the 500-foot notification radius.

Step 5

Neighbors have 45 days to comment on your application. If protests are submitted, the County may conduct further review and the application could be subject to a Planning Commission hearing.

Step 6

Following the 45-day comment period, if there are no protests, the property is not agriculturally zoned, and the planner has completed their review, the application may proceed toward permit issuance.

Step 7

Properties requiring a Planning Commission hearing will receive instructions regarding when to post hearing notices and when neighbor mailings must be sent.

Step 8

The Planning Commission will make a final decision to approve or deny the application.
